What Happens When You Fail to File Your Tax Return

Have you neglected to file your income tax returns for the past two, five, ten or more years? Perhaps you had a problem with the IRS many years ago, which snowballed into an overwhelming liability so you simply stopped filing because you thought the problem would only get worse?

At the Tax Practice of IIT Chicago-Kent College of Law, we see this situation frequently. Our approach is to first get all your delinquent historical returns prepared by one of our experienced attorneys. This normally includes any "original" returns to take the place of the "substitute" returns that may have been prepared by the IRS on your behalf, which by design failed to account for all the deductions, exemptions and other tax benefits to which you may have been entitled.

How many years do we go back? The IRS typically requires six years, though in some circumstances (most commonly, when there is an older liability on its books), we will need to go back further.

What if you don't have your tax records from these older tax years? Not a huge problem. We can access your "wage and income" transcripts from the IRS on-line so we know what was reported to the government – always the starting point. From there, we work with you to reconstruct your historical tax positions with as much accuracy as possible so you don't now overstate your tax liabilities.

Next, and now knowing what your total tax liability due and owing is, we customize and recommend a plan to resolve the debt – offer in compromise, non-collectible status, full or partial installment agreement – depending on your current financial ability to pay. After you approve the plan (sometimes choosing among the several options), we prepare the proposal and aggressively negotiate with the IRS, including representing you in any administrative appeals that may become necessary and warranted if we encounter an unreasonable bureaucrat along the way!

The goal is to get you back in the system, so you can comfortably meet your obligations and move forward in compliance, without worrying about the great unknown.
