Internal Revenue Service and Illinois State Tax Debt Relief Services

Are you receiving notices of money owed to the IRS or Illinois Department of Revenue? If you owe back taxes, it is important to take proactive steps to resolve the situation. If you simply ignore these notices, eventually you may wind up with a tax lien on your property or even a levy (seizure of funds) from your bank account. Maybe you are afraid to deal with the issue because you cannot pay what they say you owe. Do not fear; there is hope for reaching a settlement you can afford.

The Tax Practice of IIT Chicago-Kent College of Law has been helping individual taxpayers and small businesses obtain federal or state tax debt relief. Headed by Professor and Chicago tax attorney Jonathan Decatorsmith, we specialize in ethically and aggressively negotiating tax debt settlements while charging reasonable fees for our services. Decatorsmith is well-known as a leading advocate for taxpayer rights, and he puts his 25 years of tax law experience to work on behalf of his clients.

Many taxpayers are not aware that tax debt relief can be obtained for federal and state taxes owed. There are a number of options we explore, depending on your individual case.

Offers in Compromise

Under the IRS Offer in Compromise program, it is possible to settle a tax debt for significantly less than the full balance owed; and in some cases, pennies on the dollar. In general, the settlement amount will be based on your ability to pay and it is our job to demonstrate to the IRS that the proposed settlement amount is all you can afford. You may also be able to reach a settlement by challenging the amount the IRS alleges you owe and/or claiming that payment in full will lead to a financial hardship in the future.

Installment Agreements

There are times when you are unable to afford a lump sum settlement even if it is a small percentage of the balance owed. In these cases, it may be better to work out an installment plan to pay off your tax debt over a set number of months at a payment you can afford.

Tax Liens Released

After we negotiate an Offer in Compromise or installment agreement, we are often able secure the release of the federal tax liens that harm your credit.

Uncollectible Status

If you are experiencing a present hardship such as being unemployed or underemployed, it is possible to request that your tax debt be placed in "uncollectible status." When the debt goes into this status, the IRS freezes all collection activity and stops all active enforcement activity, such as levies or seizures until you are able to get back on your feet financially. Uncollectible status is not always a permanent solution, but it can be extremely helpful in buying you some much-needed time to recover your finances.

If you are facing a large IRS or Illinois Department of Revenue tax debt, do not ignore it; take action to resolve the debt before things get any worse.
